A businessman and a lawyer accused of conspiring to defraud Agricultural Development Corporation land worth millions of shillings have failed to plead to the charges.
This after Abdullahi Maalim and lawyer Nyareru David Bosire failed to appear in court on 19th December 2024.
Chief Magistrate Susan Shitubi deferred the plea taking for Bosire to 20th January 2025 after his lawyer informed the court that he was bereaved.
However, a warrant of arrest was issued against Maalim since no reasonable explanation was give for his failure to attend court.
According to the charge sheet, the two are accused of conspiring to defraud ADC by preparing and registering a lease agreement for a parcel of land certificate of title No. Galana Ranch/Block 1/1 in favour of Sahal Agro-Holdings Limited, defrauding ADC outstanding rental balance of Kes172,202,000 for 100,000 acres leased to Sahal.
The two are alleged to have committed the offense on 19th May 2021 in Mombasa County, jointly with others not before court.
Maalim is also charged with forging a lease agreement for the said land purporting it to have originated from ADC.
He is alleged to have committed this offense on diverse dates between 10th and 17 February 2021 at an unknown place, with intent to defraud.
Lastly, Maalim is accused of obtaining registration of the lease by false pretenses.
The charge sheet states that on 19th May 2021, Maalim, with others not before court wilfully procured registration of lease for the said land in favor of Sahal Agro-Holdings by pretending that the duly executed lease document originated from ADC.
